These are the official rules (“Rules”) for The Pay My Mortgage Giveaway (the “Promotion”).  If you participate in the Promotion, you (“Entrant”) agree to comply with and be bound by the Rules.

Sponsor:  The sponsor of the Promotion is Evolve Home Loans with offices at 14201 N. 87th St. Bldg C-135 Scottsdale, AZ 85260.  All questions regarding the Promotion should be directed by e-mail to Promotions@evolvehomeloans.com

No purchase necessary:  NO PURCHASE OR PAYMENT IS NECESSARY TO PARTICIPATE IN THE PROMOTION OR WIN.

Residence, Home Ownership and Jurisdiction Requirements:  An Entrant must be an individual who is legal resident of the U.S., and at least the age of majority in his or her jurisdiction.  Further, the Promotion is limited to Entrants who are Arizona homeowners residing in Arizona and either have an existing mortgage on an Arizona home at the time of entry or will have an existing mortgage on an Arizona home by the end of the Promotion Period.  The mortgage must be in good standing. The Promotion is void where any aspect of the Promotion is prohibited by law or where registration, bonding or translation is required.  Entrants who do not meet the eligibility requirements will be disqualified and unable to win.

Participation/Eligibility:  The Promotion will start at 12:00 a.m. Mountain Standard Time, January 12, 2022, and continuing through 11:59 p.m. Mountain Standard Time, March 31, 2022 (the “Promotion Period”), unless, as of March 31, 2022, Sponsor has not funded 100 loans, calculated from the Promotion start date.  If less than 100 loans have funded, Sponsor may elect in its sole discretion to extend the Promotion Period by posting notice of the extension on The Pay My Mortgage Giveaway website at https://evolvehomeloans.com/pay-my-mortgage/ (the “Site”).  During the Promotion Period you may obtain entry into the Promotion in the following ways:

• Complete a loan application with Evolve Home Loans during the Promotion Period. Your application may be completed online through www.evolvehomeloans.com/pay-my-mortgage, by applying directly with an Evolve Home Loans mortgage rep, or through written correspondence to Evolve Home Loans at 14201 N. 87th St. Bldg C-135 Scottsdale, AZ 85260 or such other address as directed in writing by Evolve Home Loans.  The loan application must be properly submitted and complete, with all accompanying required documents and information. Upon successfully completing a loan application, including providing all required documentation, you will be asked if you would like to be entered into the Promotion.  If you agree to enter the Promotion, you will receive one entry into the Promotion for each properly completed loan application.  In addition, for each loan that is approved and funded during the Promotion Period, you will receive ten bonus entries at the time of funding.
•  In addition to obtaining entries by completing a loan application, you may download the alternative entry instructions at www.evolvehomeloans.com/pay-my-mortgage/rules/mail-in-entry, complete the requirements, including providing all requested supporting documentation to verify your eligibility for entry, and returning it during the Promotion Period by mail to: Evolve Home Loans, Attn:  The Pay My Mortgage Giveaway, 14201 N. 87th St. Bldg C-135 Scottsdale, AZ 85260.  The entry form must be received by the expiration of the Promotion Period.  Entries mailed during the Promotion Period but not received until after it closes will not be entered into the Promotion.  Each Entrant is limited to one entry by this method, and multiple entries submitted by this method will be grounds for disqualification. 

You may not enter more times than indicated, whether by using multiple loan applications, addresses, identities, devices or otherwise, to circumvent the rules.

NO PURCHASE OR PAYMENT IS NECESSARY TO RECEIVE AN ENTRY FORM. 

By submitting an entry to the Promotion, you are opting into receiving marketing and promotional communications, including email, from Sponsor.

No entries will be accepted after the Promotion Period. Proof of submission of an entry shall not be deemed proof of receipt.

Employees, independent contractors that directly work with or service the Sponsor, officers, and directors of Sponsor, its affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, and the immediate family members and persons living in the same household of such persons, are not eligible to win a prize in the Promotion.

Prizes:   Sponsor will award one prize (approximate retail value to not exceed $24,000).  The prize is for Sponsor to reimburse, monthly, the winner’s eligible home mortgage payment, up to $2,000 each month, for the 12-month period immediately following the end of the Promotion Period (the “Covered Mortgage Period”).  If the winner’s eligible home mortgage payment is less than $2,000 per month at any time in the Covered Mortgage Period, the winner will be reimbursed their actual eligible home mortgage payment. If the winner’s eligible home mortgage payment is greater than $2,000 per month at any time in the Covered Mortgage Period, the winner will be reimbursed a maximum of $2,000 per month.  Winner’s eligible home mortgage payment is their standard, required monthly payment over the life of the mortgage verified with Sponsor at the time of winning, and excludes any optional additional principal or interest payments a winner may elect to make during the Covered Mortgage Period.  Should the winner refinance or sell the home associated which the eligible home mortgage payment during the Covered Mortgage Period, the winner forfeits winner’s right to additional prize payments.  

The winner will be required to submit during the Covered Mortgage Period monthly verification of the Winner’s eligible home mortgage payment, including that the winner remains in good standing under the applicable mortgage.  The prize will be awarded in the form of a monthly reimbursement check from Sponsor and may take 3-5 weeks from receipt of all required monthly payment verification information by winner to issue.

ALL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER.  Winner will receive an IRS Form 1099 for the approximate retail value of the prize.

The prize made available for this Promotion may not be awarded in the event Sponsor does not receive enough qualified and eligible entries. Specifically, the prize may not be awarded if 100 valid entries are not received from the closing of loans with Evolve Home Loans during the Promotion Period.  Further, Sponsor reserves the right to substitute the prize with a prize of equal or greater value if the advertised prize is not available. Under no circumstances shall more than one prize be awarded.

Winner Selection:  Provided that at least 100 valid entries are received from the closing of loans with Evolve Home Loans during the Promotion Period, the presumed winner will be selected by random drawing of all eligible entries.  The drawing will be conducted within ten business days of the close of the Promotion Period.  The odds of winning will depend upon the number of entrants received. 

Announcement of Winner:  The presumed winner will be notified by email promptly following the drawing, and required to respond to the Sponsor in writing with all required eligibility verification information and, assuming verified as eligible, a complete Winner’s Affidavit accepting the prize, all requested IRS forms (including 1099) and any other similar documents required by Sponsor (including verification that the winner’s mortgage is in good standing) within 10 business days after notification pursuant to the terms of the notification.  Notification will be sent to the presumed winner’s email address of record on the entry form.  If the notification cannot be delivered to such email address or the presumed winner fails to timely accept or qualify for the prize, the prize will be forfeited, and an alternative presumed winner will be selected.  Sponsor, in its sole discretion, may require verification of the presumed winner’s identity by a showing of valid government-issued photo ID. In addition, the presumed winner must provide such documentation of presumed winner’s mortgage payments that Sponsor reasonably requests.  For the winners list, send either a written request or email request to Sponsor at the address set forth above.  All decisions by Sponsor are final and binding in all matters relating to this Promotion.

License to Display and Disclose:  Entrant, by submitting an entry, hereby grants Sponsor and its subsidiaries and their respective affiliates, the right and license to display the Entrant’s name and image in any manner and in any medium for promotional purposes without additional compensation, including posting in a winner’s list and on marketing and promotional materials (such as on billboards, advertisements, booths at trade shows and on radio, television and other commercials, videos, websites and social media accounts), both during and following the term of the Promotion. Entrant acknowledges that Sponsor and its subsidiaries, and their respective affiliates may be required to disclose the winner’s address to state and local regulatory authorities.

Limit of Liability:  SPONSOR SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS, DAMAGE, COST, OR INJURY THAT ARISES FROM OR RELATES TO PARTICIPATION IN THE PROMOTION, OR WINNING OR USE OF A PRIZE, INCLUDING BUT NOT LIMITED TO: (I) LATE, LOST, DELAYED, DAMAGED, MISDIRECTED, INCOMPLETE, OR UNINTELLIGIBLE ENTRIES; (II) TELEPHONE, ELECTRONIC, HARDWARE OR SOFTWARE PROGRAM, NETWORK, INTERNET, OR COMPUTER MALFUNCTIONS, FAILURES, VIRUSES OR DIFFICULTIES OF ANY KIND; (III) FAILED, INCOMPLETE, GARBLED, OR DELAYED COMPUTER TRANSMISSIONS; (IV) THE DOWNLOADING OF ANY MATERIAL IN CONNECTION WITH THIS PROMOTION; OR (V) ANY OTHER CONDITION THAT MAY CAUSE THE PROMOTION TO BE DISRUPTED OR CORRUPTED.  SPONSOR RESERVES THE RIGHT, IN ITS SOLE DISCRETION AND WITHOUT PRIOR NOTICE, TO SUSPEND OR CANCEL THE PROMOTION OR ALTER THE RULES FOR ANY REASON, INCLUDING, BUT NOT LIMITED TO, IF AT ANY TIME A COMPUTER VIRUS, TECHNICAL PROBLEM, OR OTHER UNFORESEEABLE EVENT ALTERS OR CORRUPTS THE ADMINISTRATION OF THE PROMOTION.

Release:  ENTRANT RELEASES AND AGREES TO INDEMNIFY AND HOLD HARMLESS SPONSOR AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS AND AGENTS FROM ANY LIABILITY WHATSOEVER FOR ANY CLAIMS, COSTS, LOSSES, OR DAMAGES (INCLUDING INFRINGEMENT OF PROPRIETARY RIGHTS, RIGHTS OF PUBLICITY OR PRIVACY OR DEFAMATION) ARISING OUT OF OR IN CONNECTION WITH: (I) THE ENTRY SUBMITTED BY ENTRANT; (II) ENTERING AND PARTICIPATING IN THE PROMOTION; AND/OR (III) ACCEPTING OR USING ANY PRIZE.  HOWEVER, NOTHING IN THESE RULES SHALL LIMIT SPONSOR’S LIABILITY UNDER ANY CATEGORY OF LIABILITY WHICH UNDER THE LAW OF AN ENTRANT’S JURISDICTION CANNOT LAWFULLY BE LIMITED.

Governing Law: The Promotion and the rights and obligations of Sponsor and Entrants will be governed by and controlled by the laws of the State of Arizona, United States of America, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings or litigation relating hereto will be instituted and prosecuted solely within the State of Arizona.  Entrant consent to the jurisdiction of the state courts of Arizona and federal court located within Arizona with respect to any action, dispute or other matter pertaining to or arising out of the Promotion.

Privacy:  Entrant information submitted directly to Sponsor as part of an Entry Form or loan application or otherwise is protected by Sponsor according to its standard data security and privacy practices.
